Pursuant to Regulation (EU) 2016/679 (the “GDPR Regulation”, or the “GDPR”) and the existing national regulations on personal data protection (jointly with the GDPR, the “Italian Privacy Regulations”), Mediobanca Innovation Services S.C.p.A., with registered office in Via Siusi 7, Milan, Italy (following “MIS”, or the “Company”), in its capacity as data controller, is bound to provide disclosure on its use of personal data.
Personal data in the MIS’s possession is usually collected directly from the data subject or from public sources.
a) Purpose and means of processing
Your data will be processed by MIS for purposes related or instrumental to the conduct of research and selection of candidates. The legal basis of the treatment is identified in the need to carry out the pre-contractual measures adopted at the request of the interested party in view of a possible conclusion of a contract of work and / or collaboration, as well as always, at the request of the interested party, for any particular categories of personal data. The processing of data is done by manual, computerized and telematic tools with logic strictly related to the purposes indicated and, in any case, in order to ensure the security and confidentiality of the data, in compliance with the provisions of current legislation.
b) Legal ground
The legal ground for the data processing resides in the pursuit of the legitimate public interest.
c) Communication and dissemination of data
These data will not be disclosed and may be disclosed, if necessary, to other companies of the Mediobanca group for personnel selection purposes and to external companies operating in collaboration with the Mediobanca group to provide processing services, instrumental or to support services for selection management. Furthermore, the Data Processors / Employees authorized to process MIS selection data and of the companies of the Mediobanca group, responsible for the pursuit of the purposes described above may also be made aware (even if only partially) of your data.
d) Categories of data processed
In relation to the purposes referred to above, the processing regards exclusively personal data, principally of a general nature. No particular categories of personal data are expected to be processed.
e) Data retention
Data retention In accordance with the principles of proportionality and necessity, personal data will be stored in a form that allows the data subject identification for a period of time not exceeding the achievement of the purposes for which they where processed, therefore taking into account:
- the need to continue to retain personal data collected for the purpose of offering the services agreed with the user or protecting the legitimate interest of the Controller, as described in the abovementioned purposes, in accordance with evaluations carried out from Mediobanca;
- the existance of specific regulatory obligations ( Italian Civil Code, Anti - money - laundering Regulation, investment services Regulation, tax monitoring law, etc.) or contractual obligations that require data processing and retention for specific periods of time.
f) Obligation to provide data
The provision of data is mandatory for the pursuit of the purposes mentioned above; therefore, any refusal to provide your data could prevent MIS from conducting the search and selection activity and not allowing your application to be considered.
g) Rights of the Data Subject
The parties to which the personal data refers are entitled at any time to obtain confirmation of the existence or otherwise of such data and to know its content and origin, to check its accuracy or ask for it to be supplemented, updated or rectified (cf. Articles 15 and 16 of the GDPR). Furthermore, data subjects are entitled to request that their data be erased, its processing limited, to request data portability and make complaints to the regulatory authority or oppose the processing of their data for legitimate reasons (cf. Articles 17ff of the GDPR). Such rights may be exercised by sending notice in writing to the following email address: privacy@mis.mediobanca.com. The Data Controller, inter alia through the appointed units, shall take steps to deal with your request and provide you with information regarding the action taken in response to your request without undue delay.
